Mindbird

Terms of service

Last updated 29 September 2026

These terms apply to businesses using Mindbird. By creating an account you agree to them on behalf of your business.

What the service is

Software for sending and receiving messages on WhatsApp, Instagram, Facebook and a website chat widget, with automation, a shared inbox and reporting. We provide the software. Your business decides what to send and to whom, and remains responsible for it.

Your account

  • Give accurate details, and keep your contact address current.
  • Everyone who signs in needs their own login and a second factor. Do not share accounts.
  • You are responsible for what the people you invite do in your workspace.
  • Tell us promptly if you think an account has been compromised.

What you must not do

You must have permission to message the people you message. In practice that means a real, recorded opt-in — not a purchased list, not addresses scraped from somewhere, and not consent given for something unrelated.

You must not use the service to:

  • send unsolicited marketing, or anything unlawful, deceptive or harassing;
  • impersonate another person or business;
  • break the WhatsApp Business Messaging Policy, the Meta Platform Terms, or the rules of any channel you connect — those apply to you directly, not only to us;
  • attempt to reach another customer's data, or to probe or overload the service.

We may suspend an account immediately where there is a credible report of abuse or a serious security risk, and will explain why.

Meta's charges are yours

WhatsApp conversations are charged by Meta, directly to the payment method on your own WhatsApp Business Account. Those charges are separate from any fee for this software and never pass through us. Meta sets those prices and can change them.

Meta also decides whether your number, your display name and each message template are approved, and can restrict or disable them. We will help, but we cannot overrule it.

Availability

We aim to keep the service running and available, but it depends on Meta, on Google and on our hosting providers, and we do not promise it will never be interrupted. Maintenance that requires downtime is announced in advance where we can.

Your data

Your contacts, conversations and content remain yours. We process them to run the service, as set out in our Privacy policy. You can export everything at any time, and you can have it deleted — see Delete my data.

Ending it

You can close your account whenever you like. Deletion follows the two stages described on the deletion page: the workspace stops immediately, and nothing is destroyed for 30 days. Take your export before that window closes.

We may end an account for a serious or repeated breach of these terms, or for non-payment, having given notice and a chance to put it right where the circumstances allow.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for lost profits, lost business or indirect losses, and our total liability is limited to the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

Changes

If these terms change materially, we will tell you before the change takes effect. Continuing to use the service afterwards means accepting the new version.
